VIRTUAL COMMENCEMENT TERMS OF USE

These Terms of Use (the “Terms of Use”) govern your access to and use of the microsite www.virtualcomm.smu.edu.sg (the “Microsite”) owned by Singapore Management University ("SMU") at 81 Victoria Street, Singapore 188065 and the virtual ceremonies, virtual photo booth and dedications (“EVENTS”) hosted on the site.

By accessing this Microsite and participating in any Events on the Microsite, you are deemed to have accepted these Terms of Use.

Participation in these events does not necessarily mean that you are graduating as the Class of 2021, as it is still dependent on your fulfilment of the graduation criteria.

 

RESERVATION OF RIGHTS

SMU reserves the right to amend these Terms of Use without prior notice. All changes will be reflected here, and users will be notified should there be significant amendments made. Your continued use of the Microsite will constitute your agreement to the revised Terms of Use.

 

PROPRIETRY RIGHTS

This Microsite and its content are protected by copyright, trademark and other forms of intellectual property laws in Singapore and, through international treaties, in other countries. All rights, titles and interests in the Microsite and its contents are owned by or licensed to Singapore Management University ("University" or “SMU”).

 

RESTRICTIONS ON USE

No part of the content or material available on this Microsite may be reproduced, republished, transmitted, uploaded, posted, or otherwise distributed in any way without the prior written permission of the University.

You may view this Microsite and its content using your Web browser and save an electronic copy, or print out a copy, of limited parts of this Microsite solely for your own information, research or study, provided you keep intact all accompanying copyright and other proprietary notices.

Modification of any part of the Microsite or any of its content or use of the Microsite or its content for any purpose other than allowed by these Terms of Use will be a violation of the University's copyright and other intellectual property rights.

 

DISPLAY AND USAGE RIGHTS OF USER-GENERATED/SUBMITTED CONTENT

By submitting images/videos/audio files/information (“CONTENT”) to the Microsite, you:

  1. Grant SMU the rights to publish, distribute, broadcast, exhibit, digitise, display, copyright, license, transfer, reproduce, translate, modify, edit or otherwise use the Content in any medium now and hereafter, perpetually throughout the world for educational, promotional, advertising or marketing purposes.
  2. You represent and warrant that the Content you post or submit to the Microsite is your original work and will not infringe on any third party right -- including copyright, trademark, patent, right of publicity or other intellectual property right, and will not slander, defame, libel or invade the right of privacy or publicity of any other person.
  3. You acknowledge and agree that SMU is under no obligation to use all or any portions of the submitted Content and have absolute discretion, without providing any reasons, whether or not to reproduce, publish, distribute, or otherwise use all or any portion of the Content.
  4. You acknowledge that no compensation will be provided for submitted content, unless otherwise stated.
  5. You acknowledge that you are required to follow and be familiar with SMU’s Content Guidelines below. If you post material or misuse the Microsite in a way that infringes another party’s intellectual property rights, or these policies, you understand that SMU may remove the Content or part of it; and in such an event you shall fully indemnify SMU based on the indemnification clause below.

 

CONTENT GUIDELINES

SMU reserves the right to remove or reject Content submitted to the Microsite that are inappropriate, such Content includes but is not limited to Content that:

  1. Does not meet with the criteria set out for the various Events hosted on the Microsite;
  2. Contains obscene, racist, unethical, dangerous, violent, politically motivated, sexual inference or legally objectionable material, or material that is not original, or may infringe upon any person’s personal or property rights, or that may violate the privacy or publicity rights of any third party;
  3. Contains or installs any viruses, worms, malware, Trojan horses or other harmful or destructive content;
  4. Was created with the intent to annoy, abuse, threaten or harass any other person;
  5. Contains inappropriate language;
  6. Fails to comply with the submission criteria, where applicable, stipulated by SMU. Music used in videos should be original music written, performed and owned solely by you or royalty-free. Otherwise, you are to ensure that you have express written permission to use and license the music for the relevant purposes and that the music is unlimited, freely transferable, perpetual, and otherwise grant to SMU all necessary rights.
  7. For photo submissions, adjustments of contrast, colour balance, sharpening, cropping, red-eye reduction, dodging and burning enhancements to photos are allowed.

 

INDEMNITY

While SMU has made reasonable endeavours to ensure that the information and Content posted on the Microsite are correct at the time of posting, SMU gives no warranty and accepts no responsibility or liability for the accuracy or the completeness of the information and materials provided here for any purpose whatsoever.

You also acknowledge and agree that SMU shall not be held responsible or liable in any way for any and/or all consequences (including, without limitation, damages for loss of profits, business interruption, or loss of information) that may be incurred by you as a direct or indirect result of using, or the inability to use, any Content on this Microsite, even if the University has been advised of the possibility of such damages in advance, and for any false claims, inaccuracies or illegal content contained on your Content or in associated information links or external websites.

You agree to defend, indemnify and hold harmless SMU from and against any claims that may arise regarding the use of the photo/video including any claims of defamation, invasion of privacy or infringement of any intellectual property rights or breach of the Singapore Personal Data Protection Act.

 

LINKS FROM THIS MICROSITE TO OTHER WEBSITES

This Microsite may contain links to other World Wide web sites or resources operated by parties other than the University. Such links are provided as a service for the convenience of the users of this Microsite. As the University has no control over such sites and resources, the user acknowledges and agrees that the University is not responsible nor liable for any content or material on or available from such sites or resources. In providing such links, the University does not in any way, expressly or implicitly, endorse the linked sites or resources or the respective contents thereof. The user further acknowledges and agrees that the University shall not be responsible or liable, whether directly or indirectly, for any damage or loss caused or sustained by or alleged to be caused or sustained by the user, in connection with the use or reliance on any information or material available on such linked sites or resources.

 

 

EVENT-SPECIFIC TERMS OF USE
 

DEDICATIONS

You can send SMU’s class of 2021 congratulatory messages by posting a photo or video to your own Instagram account, or by creating a post on the SMU Commencement Facebook page (www.facebook.com/SMUcommencement), and including in the post, the hashtag #SMUVirtualComm (“Dedication”)

By sending a Dedication, you agree to abide by the CONTENT GUIDELINES stipulated in the Microsite and allow SMU to publish your Dedication on the Microsite.

You acknowledge that no compensation will be provided.

 

VIRTUAL CEREMONIES TERMS OF USE

Registration for any of the Virtual Ceremonies hosted on the microsite constitutes your acceptance of these terms of use.

  1. You will need to register to attend the virtual ceremonies conducted by Singapore Management University. By registering for the virtual ceremonies, you consent to SMU collecting, using and/or disclosing your personal data for the following purposes: To provide details, updates and information relating to the Virtual Commencement organised by SMU that you are signing up for. You hereby agree that you fully understand that your personal data may be shared with SMU partners/affiliates and other third- party service providers that SMU may engage to deliver the said details, updates and information to you. You can find out about your rights and choices and how your information is used here.

  2. You agree to respect the Intellectual Property Rights of SMU service providers and comply with Zoom’s Acceptable Use Policy and SMU’s Electronic Resources Policy.
